1. KEY DEFINITIONS

1.1. www.emedical.lt - e-shop located at www.emedical.lt.

1.3. You / Buyer - a customer who purchases or orders goods in the E-shop and is their end user or uses other services provided in the E-shop.

1.4. Personal data means any information that can be used to identify a person, as well as any information about a person that has already been identified. How the Buyer's personal data is processed is described in the Privacy Notice.

1.5. Working day - every day of the week, except for Saturdays and Sundays and public holidays, which are announced as non-working days in accordance with the legal acts of the Republic of Lithuania.

1.6. Rules - the rules of use of this e-shop www.emedical.lt.

1.7. Pick-up point - a physical pick-up point at the address specified by the seller.

1.8. Loyalty program - conditions under which you can receive special discounts and / or other exclusive offers www.emedical.lt

1.9. Specialist consultation - a service provided by means of specialist communication, helping the client to choose the goods that are best suited for a particular buyer.

1.10. Privacy Statement - A privacy statement that defines the purposes, sources, legal basis of the personal data you collect and process, sets out the rights of data subjects and the procedures for enforcing them, as well as other information required by applicable law to protect your personal data.

1.11. Goods - goods sold online at www.emedical.lt.

1.12. Emedical online account / Account - a personal account created in the e-shop www.emedical.lt and protected in the Buyer's name and password.

2. GENERAL PROVISIONS

2.1. An e-shop is a retail and wholesale store focused on Buyers who purchase Goods or services at specified prices.

2.2. These Rules establish the general conditions for using the www.emedical.lt online e-shop. Relationships which are not regulated by these Rules or regulate them only partially shall be regulated in accordance with the procedure established by the legal acts of the Republic of Lithuania.

2.3. By registering or placing an order in the E-Shop without registration, the Buyer unconditionally confirms that he is properly acquainted with the Rules and the Privacy Notice and undertakes to comply with them. The Buyer is not given the opportunity to place an order for goods or services in the Electronic Store if he is not acquainted with the Rules and the Notice or does not agree with them. In cases where the Buyer partially or completely does not agree with all or part of the Rules and / or the Notice, he must not click the "register" button, otherwise the Buyer is considered to accept and accept the obligations and responsibilities arising from this action and agree to the Rules and the Notice in full.

2.4. The Seller does not assume any risk or responsibility and is unconditionally released from it if the Buyer has not read the Rules and the Notice in part or in full, even though he has been given such an opportunity.

2.5. The Seller confirms that it is responsible for the sale of the goods ordered in the E-Shop and the proper delivery of the purchased goods, the quality of the goods, the proper fulfillment of the return conditions and the implementation of other rights and obligations of the seller provided by law.

2.6. The Seller reserves the right to change, amend or supplement the Rules. When the Buyer makes a purchase in the E-Shop, the Rules in force at the time of placing the order apply, therefore the Buyer is recommended to get acquainted with the Rules and the Notice every time the shop is made.

2.7. The Seller has the right to restrict the Buyer's use of the E-Shop or cancel the Buyer's registration without notice if the Buyer uses the E-Shop in violation of these Rules, tries to damage the stability and security of the E-shop or otherwise violates the legislation of the Republic of Lithuania.

2.8. The seller reserves the right to limit orders for very large quantities if there is an extraordinary shortage of certain products on the market.

2.9. The Seller may temporarily or permanently terminate the activities of the E-Shop without notifying the Buyer in advance. In this case, all rights and obligations provided for in these Rules or applicable legislation in relation to orders already executed or in progress remain valid.

3. REGISTRATION IN THE ELECTRONIC STORE

3.1. A visitor of the E-shop, in order to use the E-shop (become a Buyer), can do one of the following:

3.1.1. buy without registration;

3.1.2. create a user account and register by entering the data marked as required in the registration field. Submission of the specified data is a prerequisite for successful registration. Upon successful registration, an individual e-purchase account of the Buyer is created, to which the Buyer can log in only by entering the e-mail address used during registration and the password created.

3.3. In the event that the Buyer registers in the E-Shop, he undertakes to keep the data (password) of logging in to the Buyer's e-purchase account and not to disclose it to third parties. The Buyer is responsible for the storage of the login data provided to him, as well as for any actions (data transfer, orders placed, user comments, etc.) performed in the E-Shop after logging in to the Buyer's e-purchase account, and the consequences thereof. If the services provided by the E-Shop are used by a third party who has logged in to the E-Shop using the login details of the Buyer, the Seller shall consider this person to be the Buyer. If the Buyer loses the login data, he must immediately inform the Seller by sending an e-mail to [email protected].

3.4. The Buyer is responsible for ensuring that the Buyer's data provided in the E-Store is accurate, correct and complete. If the data provided by the Buyer in the E-shop changes, he must update them. In no event will Seller be liable for damages incurred by Buyer and / or third parties as a result of Buyer providing incorrect and / or incomplete personal information or failing to change or supplement the information as a result of such change. If the Buyer provides Personal Data of third parties when using the E-Shop, the Buyer is responsible for the legality of the submission and use of such data.

3.5. The Buyer has the right to freely change, supplement or submit a request to the Seller to cancel his registration at any time in his account.

4. ORDERING GOODS

4.1. To order goods from the E-shop, the Buyer must log in to his e-purchase account or select the purchase without registration feature. If the Buyer has not filled in the form in the Buyer's e-purchasing account before ordering the goods, he must provide the data necessary for accepting the order before finally confirming the order of goods.

4.2. The purchase and sale agreement in the e-shop is considered concluded from the moment when the Buyer, having formed a shopping cart, indicated the delivery address of the goods, selected the payment method and read the Rules, order fulfillment conditions and other additional information, clicks the "Confirm" button.

4.3. The goods are considered ordered when the Buyer receives a confirmation at the e-mail address specified by the Buyer that the Buyer's order has been started. If the Buyer chooses to pay for the goods at the moment of placing the order, the order starts to be executed after the moment is credited to the Seller's bank account. The Buyer is informed about the start of the order by e-mail.

5. PRICE OF GOODS AND PAYMENT FOR GOODS

5.1. The prices of the goods in the E-shop and the formed order are indicated in euros with the added value added tax (VAT). The Buyer may pay for the goods in the official currency of his country or in euros. In the event of a change in the official currency or in a currency other than the euro, the prices of the goods shall be converted at the official selling rate of the currency in force on that date.

5.2. The price of the goods valid at the time of order confirmation applies to the goods.

5.3. For the collection of goods at the Seller's pick up point, delivery by courier and / or delivery to the terminal / post office, the rates valid at the time of placing the goods order are indicated in the "Delivery of goods" section of the E-shop menu. The delivery price of the goods applies to the whole ordered shopping cart and is not divided into individual goods.

5.4. The buyer can pay for the goods in one of the following ways:

5.4.1. payment using the electronic banking system is a prepayment via the electronic banking system used by the Buyer in a bank or bank branch with which the Seller has concluded a service agreement. The payment shall be deemed executed when the Bank confirms to the Seller that the payment order has been executed successfully;

5.4.2. payment in cash or by bank card, whichever is possible, by paying them to the courier at the time of delivery of the goods to the address specified by the Buyer. Only during the period when such payment method is indicated among the possible payment methods www.emedical.lt;

5.4.3. prepayment by payment card. You can pay with VISA or MASTERCARD cards. Card payments are made only if the bank that issued the card participates in secure online payment programs (MasterCard SecureCode or Verified by Visa). After entering the card data, you can be redirected to the page of the bank that issued your card to enter the security code, which is required to confirm your identity.

5.5. No later than within 2 (two) working days from the delivery of the goods to the Buyer, the VAT invoice issued by the Seller shall be submitted to the Buyer by the e-mail specified by the Buyer. Invoice data is automatically generated based on the data provided by the Buyer and cannot be adjusted after placing the order. Only during the period when such payment method is indicated among the possible payment methods www.emedical.lt;

5.6. Product discounts are not cumulative.

6. DELIVERY AND WITHDRAWAL OF GOODS

6.1. The buyer can pick up the goods in one of the following ways:

6.1.1. When picking up the goods at the pick-up points specified by the seller;

6.1.2. Picking up the goods at the selected post machine;

6.1.3. Delivery of goods to the address specified by the buyer by courier.

6.2. Terms, conditions and prices of delivery of goods are specified in the Rules of Delivery of Goods.

6.3. The goods must be picked up from the collection point no later than within 10 days from the confirmation that the ordered shopping cart is already ready for collection.

6.4. The buyer, having chosen the method of delivery of goods by courier, undertakes to indicate the exact delivery address of the goods and to pick up the goods at the delivery time agreed with the courier. The buyer must ensure that the goods are picked up by the buyer or another person to whom the buyer has given the order number at the delivery time agreed with the courier at the place of delivery provided at the time of the order. By disclosing the order number to another person, the Buyer assumes responsibility and has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.

6.5. Goods that are delivered to the Buyer by post machine can be picked up around the clock. Goods must be picked up from the terminal no later than the storage period specified by the post machine operator. When the shipment is delivered to the terminal selected by the customer, he is informed by a short SMS message and e-mail. a letter with codes to pick up the shipment. The seller does not take responsibility for the goods taken back by another person to whom the buyer has transferred the order withdrawal codes. By disclosing the post machine door code or other data related to the order to another person, the Buyer assumes responsibility and has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.

6.6. The buyer, accepting the purchased goods, before signing the delivery documents (if applicable) has the opportunity to inspect the condition of the outer packaging of the consignment and if it is damaged, the buyer has the right to inspect the order content - packaging, quantity, quality and range in front of the Seller's representative . If the Buyer notices defects in the goods or discrepancies between the shipment and the order, the Buyer must not accept the shipment and fill in a special shipment inspection report together with the Seller's representative. If the Buyer confirms the delivery documents of the goods without comments, it is considered that the goods have been delivered to him in the complete package and in the intact packaging of the consignment.

6.7. If the Buyer's shopping cart contains at least one product, the Seller of which cannot deliver the desired quantity to the Buyer within the deadlines specified in the Goods Delivery Rules, the Seller shall immediately inform the Buyer at the e-mail address or telephone number specified in his e-purchase account and indicate the possible delivery time. If the buyer does not agree with the changed delivery term, he can cancel the order. In this case, the Seller shall refund the amount paid to the Buyer under the previous order within 14 days from the cancellation of the order.

6.8. Delivery to the post machine is not possible if:

6.8.1. The weight or volume of the goods does not comply with the maximum laid down.

6.9. If delivery of the goods is not possible due to the fault of the Seller (for example, the Buyer specified the wrong address when ordering the goods, the Buyer or recipient is not found at the specified address, etc.) or the Buyer does not pick up the goods at the time agreed with the courier, The seller may terminate the contract of purchase and sale of goods without prior notice. If in the case provided for in this clause the Seller terminates the purchase and sale agreement, the Seller shall return the amount paid for the goods to the Buyer to the bank account from which the payment was made within 14 days, less the delivery costs incurred by the Seller.

6.10. The seller reserves the right to limit the choice of collection points for certain categories of goods at critical air temperatures or in other cases.

7. WITHDRAWAL OF THE CONTRACT. EXCHANGE AND RETURN OF GOODS

7.1. The buyer has no right to withdraw from the contract of sale and return the following goods to the seller:

7.1.1. Medicated preparations if product box was opened;

7.1.2. Quality foods, including food supplements if product box was opened;

7.1.3. the quality of the goods used by the Buyer, damaged them, damaged their packaging or other actions taken by the Buyer, the product lost its appearance, as well as not all complete goods (for example, lost specific parts, no instructions for use or warranty booklet, if issued, and etc.);

7.1.4. Other goods that the Seller has the right to refuse to accept in accordance with the applicable legislation.

7.2. Goods are considered to be of defective quality if the goods have expired, contain prohibited substances, due to improper storage conditions before delivery to the Buyer the consistency or other essential characteristics of the goods have changed, the goods are mechanically damaged, their packaging is damaged or there are other defects. . Goods that have an expiration date are sold online at www.emedical.lt only with an expiration date.

7.3. The Buyer has the right to return to the Seller those goods ordered or purchased in the E-shop that are not specified in Article 7.1 of these Rules. By renouncing the concluded contract of purchase and sale of goods in respect of all or part of the goods included in the order. In order to exercise this right, the Buyer must:

7.3.1. not later than within 30 (fourteen) days from the day of delivery of the goods to the Buyer to inform the Seller about the withdrawal from the contract to his e-mail address [email protected], filling in the withdrawal form submitted to him; and

7.3.2. not later than within 14 (fourteen) days from the day of informing the Seller about the withdrawal from the contract, as provided for in Article 7.3.1. to transfer the goods to the Seller together with the purchase document (purchase receipt and / or VAT invoice) and other related documents (for example, the warranty book), if applicable, 7.7. in the manner provided for in

7.4. Returned or exchanged quality goods must be undamaged, have not lost their commercial appearance (labels have not been removed and damaged, protective films have not been torn off, etc.) and must not be used. The product must be returned in the original packaging, the same set as received by the Buyer, be sure to provide the product purchase document, warranty card (if issued), instructions for use and other accessories of the product. If the product is not complete, is damaged, untidy or is not properly packaged, the Seller has the right not to accept the product, not to change it and not return the money paid by the Buyer for the product.

7.5. 7.3 of these Rules. Only the Buyer who is considered a consumer according to legal acts, i. y. a natural person who declares his will to buy, buy and use a good for personal, family, household needs not related to business or profession.

7.6. Goods of incorrect quality shall be replaced or returned in accordance with these Rules and the legal acts of the Republic of Lithuania in force at the time of acquisition of the goods. Buyers are provided with a warranty under the law under which the Seller is liable for defects in the item that become apparent within two years of delivery of the item.

7.7. The goods may be transferred (returned) to the Seller:

7.7.1. If the goods have been picked up by the Buyer at the pick-up point, the goods shall be returned to the same pick-up point;

7.7.2. If the goods have been delivered to the Buyer by a courier, at the Buyer's choice the goods are returned at the collection point or sent by courier to the address agreed with the seller;

7.7.3. If the Buyer wishes to return the goods by post or courier, the return conditions are coordinated individually by the Buyer contacting the Seller by e-mail [email protected].

7.8. In cases of return of goods specified in the Rules, the money paid for the goods shall be returned to the Buyer:

7.8.1. if the purchased goods have been paid for in cash upon collection of the goods at the collection point, the amount paid by the Buyer for the goods shall be refunded in cash at the time of return of the goods;

7.8.2. if the Buyer has paid for the goods through the electronic banking system or payment card (VISA or MASTERCARD) used by the Buyer, the Seller shall return the amount paid for the goods to the buyer within 14 (fourteen) days from the date of return, transferring money to the payer's bank account. If the purchased goods were paid for in cash by courier at the time of delivery to the Buyer, the Seller shall return the amount paid for the goods to the buyer within 14 (fourteen) days from the date of return of the goods by transferring the money to the payer's bank account.

7.9. If the returned goods were delivered by courier, i.e. y. The Buyer has chosen the method of delivery of the goods, which is subject to an additional service fee, the Seller has the right to deduct from the amount paid to the Buyer for the goods the costs incurred by the Seller for the delivery of the goods.

8. PROCESSING OF PERSONAL DATA

9. FINAL PROVISIONS

9.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these Rules.

9.2. Any dispute, disagreement or claim arising from or related to these Rules and the violation or validity of the Rules shall be resolved through negotiations, failing which an agreement shall be finally settled in the court of the Republic of Lithuania in accordance with the laws in force in the Republic of Lithuania.

9.3. In the event of damage, the guilty party shall indemnify the other party for direct losses in accordance with the procedure and on the grounds established by the legal acts of the Republic of Lithuania.

9.4. The Buyer, wishing to express his opinion, submit a complaint or feedback, may contact the Seller by e-mail [email protected], on working days from 9 am to 6 pm. The response to the Buyer's request shall be provided within 10 working days.
